Dwdws.com Web Design Terms and Conditions

Definitions: -

"Client Summary": - The summary that Dwdws.com will provide to the client, which includes commission pricing details, and other particulars.

"Commission":- The web design process is a period termed as the commission.

"Web Development Cycle": - The process at which the web site will be designed, and developed

In accordance with the Consumer Protection Act, you are entitled to a 7 days cooling off period, during which time you can cancel you hosting.

1).

The following terms and conditions apply to all web site design services offered by Dwdws.com. By ordering services from Dwdws.com you are agreeing to the following terms and conditions.

2).

We reserve the right to refuse to construct a web site which we may judge as unfit due to content or otherwise. This includes, but is not limited by, sites containing adult oriented material, sites which promote hatred towards persons belonging to any ethnic group, religion or sexual orientation and sites which infringe copyright or are contrary to UK and International laws.

3).

The acceptance of a commission shall be deemed as a contractual agreement between the client and Dwdws.com.

Should the client want to make site wide changes to the web site after the date that the site is made available online, that is after the commission period has expired, then Dwdws.com will charge the client appropriately. Site wide changes are, but not limited to: - Style, general site layout, complete text content, Adding additional pages / menu sets to the site.

Additional pages required by the client will cost on average £55 - £100 based on particular circumstances. Dwdws.com will discuss this with the client as and when required.

4).

On acceptance of the commission by the client, an advance of 50% of the total due is payable. On completion of the web site, Dwdws.com will then invoice the client for the remaining amount.

All amounts due for any updating and maintenance of the web site must be paid in advance.

5).

Web site updating, maintenance, SEO, Google Ad Words, Search Engine Submission, web site statistics logs, and all other services are separate from the web site commission, and Dwdws.com will discuss with the client the appropriate fee for web site updating.

6).

Dwdws.com cannot always guarantee to start work immediately on a commission but will arrange a date with the client as to when work can commence.

7).

All material, both text and images, supplied by the client and used in the construction of the client's web site, will remain the client's property, unless the content derives from other 3 rd parties. In which case, Copyright law is applicable. All such material will be assumed to be the property of the client and free to use without fear of breach of copyright laws.

8).

The copyright for all material provided by Dwdws.com , such as HTML code, graphics, photographs and text, will remain the property of Dwdws.com until such time as payment has been made in full whereupon they will become the property of the client.

9).

Dwdws.com makes every effort to design pages which display acceptably in the most popular current browsers, but cannot accept responsibility for pages which do not display acceptably in new versions of browsers released after pages have been designed.

10).

Dwdws.com will submit a client's web site to several of the major search engines. The fee for which is included within the Client Summary Pricing document. If a client wishes Dwdws.com to promote a web site as a separate commission, Dwdws.com will make every reasonable effort to promote the web site effectively but cannot guarantee high placing in search engine results.

11).

Dwdws.com can accept no responsibility or liability if any search engine, online directory or search site, submitted to as part of a web site promotion commission, chooses not to list a client's web site.

12).

If applicable Dwdws.com will initially place the client's web site on one of Dwdws.com 's demonstration servers during an order so that the client may view and comment upon the web site's progress. When both Dwdws.com and the client agree that the web site meets the criteria agreed during the commissioning process, Dwdws.com will invoice the client for the full amount due for the commission. On receipt of payment, Dwdws.com will publish the web site on the client's server, or provide the source code for the site via a download (or cd-rom disk) for the client to upload.

13).

Dwdws.com will load the client’s web site onto the Internet via FTP (File Transfer Protocol), which is the standard technology. The client may purchase FTP software, such as WS_FTP Pro software. FTP will incur no charge to the client. FTP software is charged at £40 approximate per licence.

14).

If at any point during the Web site Development Cycle a client wishes to cancel, they may do so but will be invoiced an amount that Dwdws.com judges to be proportional to the amount of work completed on the commission.

15).

If, during the Web site Development Cycle, the client does not supply the content required in order to complete the commission within the set deadline date, the deadline date will be moved forward. Dwdws.com will decide on the revised deadline date.

16).

If, during the Web site Development Cycle, the client does not supply the content required in order to complete the commission within the set deadline date, Dwdws.com will invoice the client as though the commission had reached the end of the Web site Development Cycle. In this circumstance, Dwdws.com will still complete the commission within the pre-defined, and pre-agreed requirements of the commission. Any additions thereafter to the commission requirements will incur an additional fee.

17).

If, during the Web site Development Cycle, the client does not supply the content required in order to complete the commission within a reasonable amount of time, Dwdws.com will consider that the client wishes to cancel the commission, and will be invoiced an amount that Dwdws.com judges to be proportional to the amount of work completed on the commission.

18).

Dwdws.com expects payment by cheque, payable to Dwdws.com, 5 working days after the date on the invoice.

19).

Any payment returned by the bank or credit card company will incur a £35 administration charge. This will be invoiced and will be added to the total outstanding debt owed by the customer. This amount will be payable within 3 working days.

20).

Dwdws.com does not undertake to maintain or update a client's web site as part of the design commission. If a client wishes Dwdws.com to maintain or update a web site as a separate commission, Dwdws.com will negotiate with the client a maintenance contract appropriate to the amount of work required. Web site maintenance may also be undertaken on a time and materials basis if the client so wishes.

21).

Dwdws.com reserves the right to alter prices at any time without notice. If a client has commissioned any web site / page design services from Dwdws.com prior to a change in prices, that commission will not be subject to any increase, but any subsequent commission may be subject to an increase.

22).

Dwdws.com reserves the right to alter prices at any time without notice. If a client has requested any other Optional / additional services from Dwdws.com prior to a change in prices, these services will be subject to any increase.

23).

The client will provide all bilingual material, where required. If the client wished Dwdws.com to translate the site, then this will incur a separate charge separate from the web service.

24).

By agreeing to these terms and conditions your statutory rights are not affected.

25).

Dwdws.com reserves the right to change or modify any of the terms and conditions contained herein.
